Terms of Service

Introduction

K5R Softwares LLC ("Company", "us", "we", or "our") operates tradeswatch.app (hereinafter referred to as "Tradeswatch", "Service(s)", "Product", "App", "Application", "Platform" or "Website").

These Terms of Service ("Terms", "Terms of Service", "Terms of Use", "Agreement") govern your use of our web pages located at tradeswatch.app operated by K5R Softwares.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. Please read it here.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood such Agreements, and agree to be bound by them.

By using our Service, you agree to these Agreements.

Terms of Service Amendments

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to check the Terms of Use periodically for changes. Your continued use of the Platform following the posting of any changes to the Terms constitutes acceptance of those changes.

Communications

By creating an account on our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Subscriptions

Some parts of our Service are billed on a subscription basis ("Subscription(s)", "Purchase(s)"). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or K5R Softwares cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting our customer support via support@tradeswatch.app.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Subscriptions. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy. We reserve the right to refuse or cancel your Purchase at any time for reasons including but not limited to: Service availability, errors in the description or price of the Product or Service, error in your order, default of payment, or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Fees Changes

K5R Softwares, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

K5R Softwares will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount. Prices for our Products and Services are subject to change without prior notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without any prior notice or liability to you.

We may also, in the future, offer new services and/or features through the Service, which we may require you to pay for in order to access.

Service Changes

We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

Refunds

We offer a limited refund policy for our subscription service.

• Eligibility: Refunds are only available for your first subscription to our Service.
• Time Limit: Refund requests must be submitted within 14 days of the initial subscription date.
• Applicability: This policy applies to both monthly and annual subscription plans.
• Subsequent Subscriptions: Any renewal, reactivation, or subsequent subscription is not eligible for a refund.

To request a refund, contact our customer support team within the specified 14-day period.
We reserve the right to deny refund requests that do not meet these criteria.

Prohibited Uses and User Obligations

You are fully responsible for your activity and usage of the Application and Services and shall comply with:

• Your obligations under these Terms and any Additional Conditions
• All our instructions in respect of the Application and the Services, including those arising out of, given under or in connection with these Terms or any Additional Conditions
• All applicable laws and regulations.

In addition, you shall not use the Application and Services in a manner that could cause damage to the Company or third parties, or the Application and the Services, or that violates the Company's any third party's rights. You agree not using the Service:

• In any way that violates any applicable national or international law or regulation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To infringe the intellectual property rights of the Company or any third party
• To engage in any activity that could disrupt the Service or its users
• To engage in any activity that could harm the Company or any third party, including, but not limited to: introducing any viruses, trojan horses, worms, or other material which is malicious or technologically harmful, attacking the Service via a distributed denial-of-service attack or attempting to gain unauthorized access to, interfere with, damage or disrupt any part of the Service, the server on which the Service is stored, or any server, computer or database connected to the Service.

Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, under our sole discretion, for any reason, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

Upon termination, your right to use the Service will immediately cease. All rights and licenses granted to you in this Agreement shall immediately terminate, but all provisions hereof which by their nature should survive termination shall survive termination, including, without limitation, warranty disclaimers, indemnity and limitations of liability.

Any fees paid hereunder are non-refundable.

Discontinuation or Modification of Service

K5R Softwares reserves the right to modify or discontinue, temporarily or permanently the Service, or any part thereof, at any time without notice. The Company will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Disclaimer Of Warranty

These services are provided by the company on an "AS IS" and "AS AVAILABLE" basis.
The Company makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein. You expressly agree that your use of these services, their content, and any services or items obtained from us is at your sole risk.

Neither company nor any person associated with company makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. Without limiting the foregoing, neither company nor anyone associated with company represents or warrants that the services, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the server that makes it available are free of viruses or other harmful components or that the services or any services or items obtained through the services will otherwise meet your needs or expectations.

Company hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.

The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

Liability

In no event will the Company, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, or licensors be liable for any damages (including, without limitation, damages for loss of data or profit, or damages for business interruption) arising out of the use of or inability to use our services, even if the Company has been advised of the possibility of such damages.

Except as prohibited by law, if there is liability found on the part of company, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. Some states do not allow the exclusion or limitation of punitive, incidental or consequential damages, so the prior limitation or exclusion may not apply to you.

Age Requirement

Our services are intended for users who are at least 18 years old.
If you are under 18, you are not allowed to use our services.

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of K5R Softwares and its licensors.

The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of K5R Softwares.

BY USING OUR SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
